Respondents Prayer : Writ Petition filed under Article 226 of Constitution of India praying for the issuance of a Writ of Mandamus directing the 2nd respondent to revise the scale of pay of the petitioner at Rs.9300- 34800 plus GP 4200 as per the G.O.Ms. No. 329 Finance (Pay Cell) Department, dated 26.08.2010 implementing the 6th pay one Man Commission report to be followed by the scale of Pay payable to the petitioner at Rs.35400 -1,30,400 as per the 7th Pay Commission in the light of his representation dated 14.03.2024.

ORDER
This Writ Petition has been filed for a direction directing the second respondent to revise the scale of pay of the petitioner as per G.O.Ms.No.329 Finance (Pay Cell) Department, dated 26.08.2010 implementing the 6th Pay One Man Commission report to be followed by the scale of pay as per the 7th Pay Commission.
2. Heard the learned counsel appearing on either side and perused the materials available on record.
3. The petitioner was appointed as a Bio-Medical Technician and his service was regularised by the proceedings dated 22.12.2009. On the request made by the employees for revision of their salary, the Government appointed a One Man Commission and on the basis of the report, the Government passed an order in G.O.Ms.No.329, Finance, (Pay Cell) Department, dated 26.08.2010, thereby ordered to revise the scale of pay for
various categories of persons. The service of the petitioner falls under the cadre of Technical Assistant. Though the Government order was implemented to all, the case of the petitioner was not considered so far. Hence, this writ petition.

In view of the above, the second respondent is directed to consider the representation submitted by the petitioner seeking re-fixation of scale of pay as ordered in G.O.Ms.No.329, Finance, (Pay Cell) Department, dated 26.08.2010, followed by the 7th Pay Commission within a period of twelve weeks from the date of receipt of a copy of this order.
5. With the above direction, this Writ Petition stands disposed of. No costs.
