ORDER
The petitioner, who apprehends arrest pursuant to a Non Bailable Warrant issued by the V Metropolitan Magistrate , Egmore, Chennai on 04.09.2024, seeks anticipatory bail.
2. According to the learned counsel for the petitioner, the petitioner has taken care of his aged father and his wife who have underwent treatment in the hospital in his native place and was unable to come to Chennai to attend the proceedings in PRC No.12 of 2021.
3. The learned Government Advocate (Crl.Side) appearing for the respondent submitted that the petitioner failed to appear before the Court.
4. I have given my anxious consideration to either side submissions and perused the materials available on record.
5.Considering the rival submissions, this Court is of the view that it is not desirable to grant anticipatory bail against the non-bailable warrant issued by the Court, for the absence of the accused. However, the petitioner is at liberty to approach the V Metropolitan Magistrate , Egmore, Chennai, seeking recall of
the warrant. On such application being filed, the learned V Metropolitan Magistrate, Egmore, Chennai, shall consider the same on merits and in accordance with law, on the very same day, uninfluenced by any observations made in this order.

With the above directions, this Criminal Original Petition is dismissed.
