The petitioner apprehends arrest for the alleged offence under Section 4(1-A) of TN Prohibition Act, in Crime No.197 of 2026 on the file of the respondent police seeks anticipatory bail.

2. The case of the prosecution is that on 28.05.2026, when the respondent police were on patrol, the petitioner along with other accused were found in illegal possession of 208 bottles of liquor. Hence, the case.

3. The learned counsel appearing for the petitioner submitted that he is an innocent person and has been falsely implicated in this case. He would submit that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for the respondent police opposed the anticipatory bail on the ground that there are two previous cases pending against the petitioner and if anticipatory bail is granted, it will send a wrong signal to the society.

Taking into consideration of the totality of the circumstances and the fact that there are two previous cases pending against the petitioner, and if anticipatory bail is granted, there is every likelihood that the petitioner would commit similar kind of offence. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.
