Since the applicant in the present application had not responded to the subpoena issued by this Court, a non-bailable warrant was issued and pursuant to the issuance of the said non-bailable warrant, he had appeared before this Court and had explained about his absence. An affidavit had been filed on behalf of him indicating that the records are not available. Mr.T.V.Ramanujam, learned Senior Counsel appearing on the behalf of the first respondent had sought permission to cross-examine him.

2. Pursuant to the said request, the matter had been listed today for cross-examining the deponent of the affidavit. He was also cross-examined by the first respondent to this application.

3. In such circumstances, I do not find any impediment in re-calling the order as prayed for in this application. Hence, the application is accordingly ordered and the order, dated 04.07.2024 made in A.No.3635 of 2023 in C.S.No.758 of 2009 is recalled.
