This Miscellaneous Petition is filed by the Government to modify the order dated 06.07.2018 made in W.P.No.14188 of 2018.

2. Heard the learned Additional Government Pleader appearing for the petitioners/respondents and the learned counsel appearing for the respondent/petitioner.

3. Being satisfied with the reasons stated in the affidavit filed in support of this petition, this petition is ordered. Accordingly, Paragraph Nos.5 and 8 of the order dated 06.07.2018 made in W.P.No.14188 of 2018 are modified as follows:

"5. The learned Additional Government Pleader would submit that the final award enquiry is pending before the fourth respondent/The Special Tahsildar. After passing final award, if there is any dispute regarding disbursement of the award amount, the matter may be referred to the Civil Court in terms of Section 18 of the Land Acquisition Act.

8. In the light of the submissions of the learned counsels appearing on either side, this Court directs the petitioner to participate in the final award enquiry proceedings, which is to be conducted by the fourth respondent/The Special Tahsildar. After passing final award, if the petitioner is aggrieved, he is given liberty to make representation before the fourth respondent/The Special Tahsildar to refer the matter to the Civil Court under Section 18 of the Land Acquisition Act for determination of the compensation amount."
