PRAYER: Transfer Civil Miscellaneous Petition filed under Section 24 of Code of Civil Procedure, praying to withdraw H.M.O.P.No. 72 of 2019 on the file of Sub Court, Panruti and transfer the same to the file of Family Court, Puducherry. The petitioner/wife seeks transfer of H.M.O.P.No. 72 of 2019 on the file of Sub Court, Panruti to the file of Family Court, Puducherry.

Transfer is sought for mainly on the ground of convenience of wife. The husband is a resident of Panruti and the wife is a resident of Mudaliarpet, Puducherry. 3.

The distance between Panruti and Puducherry is less than 50 kilometers and the proceedings at Panruti are before a Sub Court where the parties need not appear for every hearing, the wife can engage a counsel and she could appear through counsel. If the Original petition is transferred to the file of Family Court, Puducherry, considerable hardship would be caused to the husband since he would be forced to appear before the Family Court for every hearing. Therefore, I do not see any justification for request of transfer.

Hence, this Transfer Civil Miscellaneous Petition is dismissed. Consequently, connected Miscellaneous Petition is closed.
