C.M.P.No.16329 of 2023 in C.M.A.No.1344 of 2023 SUNDER MOHAN,J.

This Application has been filed seeking to send back the records in MCOP.No.57 of 2018 on the file of the Special District Judge, Erode with a direction to return the same to this Court before disposal of the present CMA.

2.Learned counsel for the appellant would submit that since the records have been sent by lower Court to this Court, he could not withdraw the compensation awarded by the Tribunal and hence prayed for a direction to return the records to the Tribunal. 3.Considering that the request made by the learned counsel for the appellant is reasonable, this Court directs the Registry to send back the records so as to enable the appellant to withdraw the compensation deposited by the 3rd respondent/Insurance Company. Thereafter, the Special District Judge, Erode, shall return the same to this Court before disposal of the present CMA.

4.Accordingly, this application is ordered as prayed for. 07.08.2023 (2/2) rst Note:Issue order copy on 09.08.2023.
