ORDER
The petitioner, who was arrested and remanded to judicial custody on 02.01.2026 for the alleged offences under Sections 5 (l) r/w 6, 7 r/w 8 of the Protection of Children from Sexual Offences Act, 2012 and Section 87 of Bharatiya Nyaya Sanhita and Section 77 of the Juvenile Justice (Care and Protection of Children) Act, 2015, in Crime No.1 of 2026 on the file of the respondent police, seeks bail.
2.The case of the prosecution is that the petitioner along with his friend attempted to commit sexual assault against the fourteen years old victim. Hence, the case.
3.The learned counsel for the petitioner submitted that the petitioner is innocent and has been in custody since 02.01.2026. He further submitted that he is ready to abide by any stringent condition that may be imposed by this Court and ready to co-operate for investigation. Hence, he prays to grant bail to the petitioner.
4.The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and produced the victim's statement recorded under Section 183 of the BNSS. Hence, he opposed for grant of bail to the petitioner.
5.Though the petitioner was charged under Section 5 (l) read with Section 6 of the POCSO Act, there are no ingredients in the statement recorded under Section 183 of the BNSS, However, the manner in which the victim was dealt with by the petitioner clearly demonstrates that the victim narrowly escaped a serious offence. Hence, considering the seriousness of the allegation, as rightly contended by the learned Government Advocate, if the petitioner is enlarged on bail that would create fear psychosis in the mind of the defacto-complainant
Consequently, this Court is of the firm view that the petitioner is not entitled for bail and this Criminal Original Petition is dismissed. 09-06-2026 ep
