This Civil Miscellaneous Petition has been filed to condone the delay of 266 days in filing the above appeal.

2. Heard the learned counsel for the petitioner.

3. Ms.R.Janani, would submit that Mr.J.Chandran, learned counsel undertakes to file vakalat for the 2nd respondent and she has got objections in allowing the petition.

4. The petitioner would aver that the case papers were misplaced and in order to trace the same, delay of 266 days occurred in filing the appeal.

5. The reasons assigned by the petitioner appears to be acceptable. Hence, this Court is inclined to allow this Civil Miscellaneous Petition subject to the condition that the interest for the delay period of 266 days shall stand waived.
