The petitioner, who was arrested and remanded to judicial custody on 29.06.2022 for the offences punishable under Sections 5(l), 5(j)(ii) and 6 of POCSO Act in Crime No.22 of 2022 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that all the accused persons have committed penetrative sexual assault on the victim girl aged about 15 years. Hence, the complaint.

3. There are totally four accused, in which the petitioner is arrayed as A2. On perusal of the statement recorded under Section 164 of Cr.P.C. revealed that the victim girl is aged about 15 years. Originally, she had friendship with A1 and utilizing the said circumstances, he committed penetrative sexual assault on the victim girl on compulsion. It was also informed to the petitioner who is a friend of A1. He also committed penetrative sexual assault on the victim girl on compulsion.

4. Therefore, the petitioner have committed very serious and heinous offence as against the minor victim girl and this Court is not inclined to grant bail to the petitioner. Hence, this Criminal Original petition is dismissed.
