The petitioner, who was arrested and remanded to judicial custody on 15.04.2024, for the offence punishable under Section 8(c) r/w Section 22(c) of Narcotic Drugs & Psychotropic Substances Act, 1985 in Crime No.181 of 1/4

2024, registered on the file of the respondent, seeks bail.

2. The petitioner herein was found in possession of 10 grams of cocaine and further search of his residence led to the recovery of 110 grams of cocaine. Hence, he was arrested on 15.04.2024 for the offences under Section 8(c) read with Section 22(c) of the Narcotic Drugs & Psychotropic Substances Act. The petitioner seeks bail on the ground that he has been in prison for more than a year and that, due to long incarceration, his fundamental right under Article 21 is violated.

3. Learned Government Advocate (Criminal Side) appearing for the respondent Police submitted that the petitioner was found in possession of a commercial quantity of a psychotropic substance and that the investigation has been completed, and the final report has been filed and taken on file by the Principal Special Court under EC & NDPS Act, Chennai, in C.C. No.790 of 2024. The case is now posted for framing of charges. 2/4

Considering the gravity of the offences, the quantity of contraband seized from the petitioner herein, and his previous antecedents of involvement in a similar case earlier, it is clear that the case of the petitioner does not satisfy the pre-condition imposed under Section 37 of the Narcotic Drugs & Psychotropic Substances Act, 1985. Hence, the criminal original petition stands dismissed.
