Respondents (R3 impleaded as per order dated 5.9.2007 in M.P.No.200/2006 in W.P.21163/2004) Writ Petition is filed under Article 226 of the Constitution of India to India for the issuance of a Writ of Certiorarified Mandamus, calling for the impugned letter dated 19.06.2003 vide Ref.No.C.P.14/SICH/AI/2002 issued by the 1s respondent and quash the same and consequently, directing the respondents to approve and confirm the petitioner as Successful Bidder of Plot No.14/3 of Hosur SIPCOT Phase II and to allot the same after receiving the balance of the bid amount.

O R D E R

The Writ Petition has been filed challenging the impugned letter dated 19.06.2003 vide Ref.No.C.P.14/SICH/AI/2002 issued by the 1st respondent and quash the same and consequently, directing the respondents to approve and confirm the petitioner as Successful Bidder of Plot No.14/3 of Hosur SIPCOT Phase II and to allot the same after receiving the balance of the bid amount. 2.

When the matter is called, the learned Counsel appearing for the petitioner restricting the claim made by the pettitioner would submit that the petitioner would be satisfied, if a direction is issued to the 1st respondent to refund the amount stated in the impugned order dated 19.06.2003.

In view of the above submission of the learned Counsel for the petitioner, without going into the merits of the case, a direction is issued to the 1st respondent to refund Rs.27,200/- as and when the petitioner furnishes the Advance Stamped Receipt for the said amount.
