2. Heard the learned counsels appearing on either side. With the consent of both sides, the Writ Petitions are taken up for hearing at the admission stage itself.
3. It is the case of the petitioners that they joined service as Conductor and retired from service on attaining the age of superannuation. The respondents settled the Provident Fund, Gratuity, Earned Leave Salary and Commutation amount with a delay. Therefore, the respondents are legally bound to pay interest to the petitioners. Therefore, the petitioners made separate representation dated 09.04.2026 and 23.03.2026, to the respondents to pay the interest for the belated payment of the petitioners Provident Fund, Gratuity, Earned Leave Salary and Commutation amount with effect from 01.05.2025 and 01.01.2025 respectively. Since there is no response, the petitioners are before this Court.
3. Heard the learned Counsel on either side and perused the materials available on records.
4. Admittedly, the Provident Fund, Gratuity, Earned Leave Salary and Commutation amount has been paid belatedly for no fault of the petitioners.
Therefore, the petitioners are entitled to interest on the same. Therefore, the Writ petitions are disposed of and a mandamus is issued directing the respondents to disburse the 6% interest for belated payment of Provident Fund, Gratuity, Earned Leave Salary and Commutation amount with effect from 01.05.2025 and 01.01.2025 respectively within a period of one (1) month from the date of receipt of a copy of this order.
