WP No. 21856 of 2026 Prayer:
This writ petition is filed under Article 226 of the Constitution of India seeking writ of mandamus directing the Respondents to disburse the belated payment of interest amount of provident fund, Gratuity Earned Leave salary and commutation amounts with effect form 01.06.2025. For Petitioner(s):
In all petitions Mr. N.Desinghu For Respondent(s):
In all petitions Mrs. S.Pavithra Standing Counsel R1 & R2
Order These writ petitions are filed for the following relief: "To direct respondents to disburse the belated payment of interest amount of provident fund, Gratuity Earned Leave salary and commutation amounts."
2.The case of the petitioners is that they were appointed in the respondent corporation on 01.01.2001 and 12.07.2000, respectively and retired from service on attaining the age of superannuation on 31.10.2024 and 31.05.2025, respectively. However, the terminal benefits have been settled to the petitioners only on 11.03.2026 and no interest has been paid for the delayed period. Therefore, the petitioners had submitted representations to the respondents on 21.04.2026 and 09.04.2026, respectively to pay interest for the delayed period. Since the same was not considered, the present writ petition has been filed. 3.The learned Standing Counsel would fairly submit that they are willing to pay the interest at the rate of 6% per annum for the belated payment of the eligible and admissible amount.
4.Heard the learned counsel for both sides and perused the materials available on record.
5.In view of the above submission of the learned Standing Counsel, this Court deems it appropriate to direct the respondents to pay interest at the rate of 6% per annum for the belated payment of admissible terminal benefits from the date of retirement till the date of actual disbursal of the terminal benefits of the petitioners within a period of six weeks from the date of receipt of a copy of this order.
6.With the above direction, these writ petitions are disposed of. No costs.
