ORDER

This criminal original petition has been filed to direct the learned Principal District and Sessions Judge under SC/ST (POA) Act, Cases, Coimbatore District to consider the bail application filed by the petitioner on her surrender in connection with Crime No.174 of 2026 on the file of the 2nd respondent police on the same day.

2. When the matter was taken up for hearing, the learned Govt. Advocate (Crl.Side) appearing for the first and second respondents submitted that in respect of the very same complaint, crime number, dispute and prayer, the petitioner already filed Crl.O.P.No.14925 of 2026 before this Court. This Court by order dated 12.06.2026 disposed of the said petition on the ground that FIR disclosed specific allegations against the petitioner and that both the petitioner and the defacto complainant had business dealings between them. He further submitted that civil proceedings as well as proceeding under NI Act are

pending between the parties and the allegations made in the complaint disclosed the commission of cognizable offences warranting a thorough investigation. Now, the present criminal original petition is filed for the same cause of action.

3. Since the dispute raised in the present petition was already considered and decided by this Court on 12.06.2026 in Crl.OP.No.14925 of 2026, the petitioner cannot filed a second petition on the very same cause of action.
