ORDER
The petitioners, who was arrested and remanded to judicial custody on 12.11.2025 based on execution of NBW dated 05.10.2021 in Spl.S.C.No.07 of 2023 on the file of the learned Fast Track Court exclusive to deal with offences under the POCSO Act at Puducherry for the offences punishable under Section 366(A) of IPC and Section 6 of POCSO Act, Seek bail.
2. Though NBW was ordered on 05.10.2021, it is the submission o the learned counsel for the petitioner that no summons were issued in the year 2018,
and he was not in a position to appear before the Court. In the meanwhile he was remanded to judicial custody on 12.11.2025. 3.The learned Government Advocate appearing for the Puducherry submitted that the petitioner is absconding and he did not appear before the Trial Court from the year 2021. Hence NBW was issued against the petitioner and thereafter he was secured only on 12.11.2025. That apart the petitioner is hailing from Uttar Pradesh and if he is released on bail, again there is the possibility of absconding.
5. Heard both sides and perused the materials available on record.
5. On perusal of records reveals that as the petitioner had committed sexual assault on the victim girl who is a minor and the petitioner is absconding before the Trial Court, due to which the entire Trial proceedings is stalled before the Trial Court.
6. In view of the above, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed. However, the Trial Court is directed to complete the trial within a period of three months from the date of receipt of a copy of this order. 11-06-2026 Index: Yes/No Speaking/Non-speaking order smn
