Respondents Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Mandamus, directing the second respondent to comply the direction as per letter dated 21.04.2016 bearing No.11320/U2/2016 issued by the first respondent.

ORDER

The petitioner claims to be the owner of property comprised in New Survey No.86/94 situate at No.12, Naravarikuppam Village, Ambattur Taluk, Tiruvallur District measuring 48 cents in Patta No.30. However, he sold certain extent of the said property to the third and fourth respondents by way of registered sale deeds bearing document Nos.3897 and 3898 of 1994 dated 24.11.94 on the file of the Sub Registrar, Red Hills. As the petitioner subsequently came to know that the third and fourth respondents had forged the non-judicial stamp papers in the aforementioned two sale deeds in page no.10 of the document No.3897 of 1994 and in page no.9 of the document No.3898 of 1994 by inserting their names in the place of one Ashok, gave a representation on 2.3.2016 to the first respondent to cancel the said documents https://hcservices.ecourts.gov.in/hcservices/

bearing document nos.3897 and 3898 of 1994. Based on the same, the first respondent also sent a communication dated 21.4.2016 to the District Registrar (Administration), North Chennai with a direction to conduct an enquiry and to take needful action. But till date, no enquiry has been conducted by the District Registrar (Administration), North Chennai as directed by the first respondent. Therefore, a direction be issued.

2. The learned Government Advocate for the respondents 1 & 2 sought sufficient time to proceed with the enquiry as directed by the first respondent. He has also submitted that notice will be issued to the petitioner as well as to the third and fourth respondents and proper enquiry will be held.

3. In view thereof, this Court hereby directs the second respondent to proceed with the enquiry as directed by the first respondent, after issuing notice to the petitioner as well as the third and fourth respondents, and pass appropriate orders within a period of six weeks from the date of receipt of a copy of this order. The writ petition is disposed of accordingly. No costs.
