PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the Additional Mahila Court, Salem to take appropriate action against the respondents for giving false evidence in DVOP 102 of 2013. For Petitioner : Mr.N.Sudharsan

ORDER

This Criminal Original Petition has been filed for a direction to the Court below to take action against the respondents for giving false evidence in D.V.O.P.No.102 of 2013.

2. The learned counsel for the petitioner submitted that the respondent had given a false evidence before the Court below during the pendency of the proceedings. The petitioner has filed a petition before the Court below and has requested the Court to proceed further to take action against the respondents in accordance with Section 195(1) (b) and Section 340 Cr.P.C. The Court below has returned the said petition on the ground that it is not maintainable. The learned counsel further submitted that it is only the Court below, which can proceed further against the respondents for giving false evidence and the petitioner cannot maintain the complaint in this regard.

3. Taking into consideration, the facts and circumstances of the case, there shall be a direction to the Court below to take the petition on file and deal with the same strictly in accordance with Section 340 of Cr.P.C.

4. This Criminal Original Petition is disposed of, with the above directions.
