This petition has been filed seeking to condone the delay of 355 days in filing the appeal.

2. Heard the learned counsel for the petitioner.

3. The learned counsel for the second respondent does not have serious objections in allowing the petition.

4. The first petitioner would aver that he is a senior citizen and due to sudden demise of his wife, he is not in a position to run his family. Hence, the delay of 355 days occurred in filing the appeal.

5. The reasons assigned by the petitioner in the affidavit appear to be reasonable and acceptable. Therefore, this Court is inclined to allow this petition, subject to the condition that the interest for the delay period of 355 days shall stand waived.
