C.M.P.No. 13118 of 2022 in A.S.No. 367 of 2022 M.DURAISWAMY, J and SUNDER MOHAN, J (Order of Court was made by M.DURAISWAMY, J.) The plaintiff in O.S.No. 15 of 2015 on the file of the District Court, Nilgiris, in a suit for partition have filed the A.S.

2. The above petition seeking for adinterim injunction not to alienate the property cannot be granted for the reason that any alienation would be hit by Section 52 of the Transfer of Property Act.

3. In such view of the matter, we are not inclined to allow the petition. Accordingly, the petition is dismissed.
