PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to call for the records of the proceedings in Crime No.154 of 2010 on the file of Shoolagiri Police Station, Krishnagiri District, for the alleged offences under Sections 294(b), 341, 324, 323(a) and 302 of the Indian Penal Code and quash the same.

O R D E R

The Criminal Original Petition has been filed seeking to quash the FIR in Crime No.154 of 2010 pending investigation on the file of the respondent Police.

2. When the matter came up for hearing on 27.01.2021, this Court passed the following order:

Mr.Muthukrishnan, Inspector of Police, who is the investigating officer was present at the time of hearing through video conferencing. When this Court posed a question as to the basis on which the petitioner was made as an accused in this case, no satisfactory answer was forthcoming. The FIR was registered in the year 2010 and till date there is absolutely no progress in the investigation.

2.The learned Additional Public Prosecutor shall go through the entire CD file https://hcservices.ecourts.gov.in/hcservices/

and assist this Court in order to pass an order in this petition. The Investigation Officer shall also be present at the time of hearing.

3.Post this case on 02.02.2021 at 2.15 pm.

3. When the matter was taken up for hearing today, Mr.Muthukrishnan, Inspector of Police was present at the time of hearing. The learned Government Advocate on instructions submitted that the name of the petitioner has been deleted from the FIR and the petitioner is not an accused in this case.

4. Recording the submissions of the learned Government Advocate, this Criminal Original Petition is closed. Consequently, the connected miscellaneous petitions are closed. s/d- Assistant Registrar True Copy Sub-Assistant Registrar jv To
