The petitioner herein under the guise of agreement has received Rs.99 lakhs from the defacto complainant and evading completion of the contract. Hence, complaint was given to the police for investigation and the petitioner been called. Contending that under the guise of investigation, the respondent police is harassing her, the present petition is filed.

The learned Government Advocate (Crl.Side) appearing for the respondent police states that contrary version been given by the petitioner and the defacto complainant regarding the transaction. Since there is an element of cheating involved in this matter, preliminary enquiry has to be conducted. Co-operation of the petitioner for enquiry is necessary. If she participate in the enquiry, there will not be any violation of law.

The statement of the learned Government Advocate (Crl.Side) is recorded. This Criminal Original Petition is disposed of directing the Investigating Officer to conduct the enquiry in accordance 2/4
with law. If any substance is available, register the FIR and proceed further in accordance with law.
