ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 305 (a) of BNS, 2023, in Crime No.572 of 2024, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner along with two others namely A1 and A3 had committed theft of diamond necklace (24g), gold nethi chuti (6g), diamond bracelet (12g), diamond earring (12g), silver gold plated earring (2 nos). Hence, the case. 3.The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that most of the items have been recovered and A1 and A3 has been granted bail. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, prayed for grant of anticipatory bail to the petitioner. 4.The learned Government Advocate (Criminal side) reiterated the prosecution case and submitted that petitioner is an habitual offender having three previous cases of similar in nature. Still hearings and cash is to be recovered. Hence, he strongly opposed for grant of anticipatory bail to the petitioner.

5.Heard the learned counsels on either side and perused the records. 6.Considering the facts and circumstances of the case, the fact that petitioner is having three previous cases of similar nature and since custodial interrogation of the petitioner is very much required, this Court is not inclined to grant anticipatory bail to the petitioner.

Accordingly, this Criminal Original Petition is dismissed. 11-07-2025 ep M. NIRMAL KUMAR, J.
