On hearing the learned Government Pleader, we direct the Judicial Magistrate - II, Ponnery to send a status report of the criminal case bearing Crime No.496 of 2006 under Section 379, 430 IPC r/w 21(1-A) 4a of Mines and Minerals Act and charge sheet is stated to have been filed against R.Venkatesan and Sudhakar.

2. We also direct the Revenue Divisional Officer, Ponnery, to produce the records qua imposition of penalty against the said two persons under Rule 36(A) of Tamil Nadu Minor Mineral Concession Rules, 1959, to verify whether procedures have been followed as the action itself has been taken belatedly after six years when directions are passed on 23.10.2009 in the present writ petition. As to the reasons why no such action has been taken, an enquiry be conducted and report be submitted to this Court simultaneously under affidavit of the fourth respondent. List on 10.07.2015 for compliance.
