The writ petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus, calling for the records of the first respondent vide G.O.Ms.No.604 dt.26.05.2008 and the impugned letter of the 2nd respondent in R.No.22370/H1/08 dated 04.06.2008 and to quash the portion with reference to the approval and recognition for the driving schools by the 2nd respondent for undergoing prerequisite training at Institute of Road Transport and further to issue directions to the respondents to permit all the driving schools having valid licence to under go the pre-requisite training at the Institute of Road Transport, Chennai. ORDER

The petitioner prays to issue a Writ of Certiorarified Mandamus, calling for the records of the first respondent vide G.O.Ms.No.604 dt.26.05.2008 and the impugned letter of the 2nd respondent in R.No.22370/H1/08 dated 04.06.2008 and to quash the https://hcservices.ecourts.gov.in/hcservices/

portion with reference to the approval and recognition for the driving schools by the 2nd respondent for undergoing prerequisite training at Institute of Road Transport and further to issue directions to the respondents to permit all the driving schools having valid licence to undergo the pre-requisite training at the Institute of Road Transport, Chennai. 2.When the matter is listed today the learned counsel for the petitioner made a submission that the matter has become infructuous and he has also made an endorsement to that effect: "It is respectfully submitted that, now the Transport Department is permitting the driving schools having heavy vehicles driving instructing training there of to give one day special training at the time of renewal. Therefore nothing survives in the writ petition. Therefore it is respectfully prays that this, hon'ble Court may be pleased to dismiss the writ petition in W.P.No.14301 of 2008 as infructuous and to render Justice."

4. In view of the above submission and endorsement made by the learned counsel for the petitioner, this writ petition is dismissed as having become infructuous. No costs. Consequently, connected miscellaneous petition is closed.
