The petitioner apprehends arrest for the alleged offence under Section 85 of BNS 2023 r/w Sections 9(m), 9(n), 9(l) and 10 of Protection of Child from Sexual Offences Act, 2012, in Crime No.20 of 2026 on the file of the respondent police seeks anticipatory bail.

2. The case of the prosecution is that the petitioner, being the husband of the de facto complainant, allegedly subjected his minor children to sexual assault. Hence, the case.

3. The learned counsel appearing for the petitioner submitted that he is an innocent person and has been falsely implicated in this case. She would submit that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, she prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police opposed the grant of anticipatory bail and by placing reliance on the statement recorded under Section 183 of BNSS, submitted that the investigation is still pending.

Taking into consideration of the totality of the circumstances, particularly the gravity of the offences, the involvement of a minor victim, the serious charges under the POCSO Act, and the specific modus operandi alleged against the petitioner, this Court is not inclined to enlarge the petitioner on anticipatory bail.
