A4 and quash the same in so far as the petitioner is concerned and consequently direct the Respondents to grant the petitioner the higher start of pay for her graduation (Degree Increment) in terms of the G.O.Ms.Nos.321 dated 02.07.1998 and G.O.Ms.241 dated 22.07.2013 read with Letter No. 874 / pay cell / 2020-1 dated 24.01.2020 of the 2nd Respondent herein with all arrears and monetary benefits within the time to be stipulated by this Hon'ble Court. ORDER

This writ petition has been filed challenging the order passed by the third respondent, dated 20.06.2020, thereby rejected the request made for advance incentive increment for those who had joined after 01.04.2013.

2. Heard both sides and perused the materials available on record.

3. The petitioner has been appointed provisionally by direct recruitment to the post of Village Administrative Officer by an order dated 31.12.2012 through TNPSC. The petitioner is also qualified with degree. Therefore, the petitioner sought for advance increment for his higher qualification. However, now, as per G.O.Ms.No.95, Human Resources Management (FR-IV) Department, dated 26.10.2023, the petitioner is not entitled for incentive increment. However, she is entitled for lumpsum increment for higher

qualification as per G.O.Ms.No.95, Human Resources Management (FR-IV) Department, dated 26.10.2023. Accordingly, the petitioner is entitled for only lumpsum amount.

4. In view of the above, the respondents are directed to grant lumpsum increment for her higher qualification as per G.O.Ms.No.95, Human Resources Management (FR-IV) Department, dated 26.10.2023, within a period of four weeks from the date of receipt of a copy of this order.

5. With the above directions, this writ petition is disposed of. Consequently, connected Miscellaneous petition is closed. There shall be no order as to costs.
