Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus calling for the concerned records from the Industrial Tribunal cum Labour Court, Puducherry relating to award dated 06.10.2017 in I.D(L).No.40 of 2012, quash the award 06.10.2017 in I.D(L). No.40 of 2012 insofar as denying 70% of back wages as illegal, arbitrary and contrary to law and consequently direct the respondent o pay the petitioner full back wages. ORDER

By consent of both the parties, this writ petition is taken up for final disposal.

2. The award dated 06.10.2017 passed in I.D(L).No.40 of 2012 on the file of the Industrial Tribunal cum Labour Court, Puducherry, has been challenged by the workman in the present writ petition.

3. Today, when the matter was called, the learned counsel for the respondent-Management submitted that, as against the same award, the Management had challenged the same before this Court, which went up for consideration before a Hon'ble Division Bench and by order dated 19.08.2019 passed in W.A.No.1226 of 2018, the present impugned award has been set aside and the https://hcservices.ecourts.gov.in/hcservices/

matter was remitted back to the Industrial Tribunal cum Labour Court for re-consideration.

4. The submission made by the learned counsel for the respondent is ratified by the learned counsel for the petitioner also.
