This application has been filed seeking leave to institute the suit in this Court, since the defendant resides outside the jurisdiction of this Court.

The suit is one for recovery of possession of the property situate within the jurisdiction of this Court.

2. Considering the above, this application is allowed granting leave to the applicant to institute the suit as against the defendant in this Court.
