IN THE HIGH COURT OF JUDICATURE AT MADRAS

DATED : 22.09.2025

CORAM

THE HON'BLE MR. JUSTICE V.LAKSHMINARAYANAN in W.M.P.No.12166 of 2025 in W.P. No.10802 of 2025 G. Banumathi ... Petitioner Vs.

Sivaguru Prabhakaran ... Respondent PRAYER: To punish the respondent herein for his willful, wanton and utter disregard to the order passed by this Court in W.M.P.No.12166 of 2025 in W.P. No.10802 of 2025 dated 25.03.2025.

For Petitioner :

Ms. L. Meenakshi For Respondents :

Mr. D. Ferdinand

ORDER

The present contempt petition arises on account of the alleged disobedience of the order of this Court in W.M.P.No.12166 of 2025 in W.P. 1/3

No.10802 of 2025 dated 25.03.2025.

2. The grievance of the petitioner is that a public toilet is being constructed in the land reserved under the open space reservation category. Considering the prima facie case, this Court had granted an order of interim injunction on 25.03.2025 and it was also extended subsequently. Pleading that the said order has been violated, the present contempt petition has come before this Court.

3. When the matter was taken up for hearing Mr. D. Ferdinand, the learned standing counsel for the respondent produced geotagged photographs. The photographs are dated 25.03.2025 and 14.07.2025. These photographs point out that no further construction has taken place after the order has been passed by this Court. Hence, I do not find any reason to initiate contempt. Accordingly, contempt petition is closed. 22.09.2025 Index : Yes/No Speaking Order : Yes / No ab 2/3
