The learned counsel for the petitioner contended that the defendant is not willing to enter the witness box. If a person is not willing to enter witness box, in that case, subject to the availability of evidence, an adverse inference can be drawn. However, witness cannot be compelled to give evidence before the Civil Court.

2. In this view of the matter, this petition is dismissed.
