This petition has been filed to condone the delay of 84 days in filing the above second appeal.

2. Considering the facts and circumstances of the case, this petition is ordered subject to following condition:

"the appellant is directed to pay a sum of Rs.2,500/- (Rupees Two Thousand Five Hundred only) as cost directly to the respondent, within a period of two weeks from today, failing which, this petition shall stand automatically dismissed.

3. On such payment, Registry is directed to number the second appeal, if it is otherwise in order.
