ORDER

The petitioner apprehends arrest for the alleged offence under Sections 8(c) read with 20(b)(ii)(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985 in Crime No.115 of 2026 on the file of the respondent police seeks anticipatory bail.

2. The case of the prosecution is that the petitioner was found to be in illegal possession of 1.300 kg of ganja. Hence, the complaint.

3. The learned counsel for the petitioner would submit that the petitioner has no connection with the alleged offence and has been falsely implicated in this case. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court. Hence, he prayed for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) strongly opposed the application and submitted that the case involves narcotic substances and that if the petitioner is enlarged on bail, it may embolden him to indulge in similar activities.

5. I have given anxious consideration to the submissions made by the learned counsel on either side and also perused the records available.

6. Considering the fact that the case arises under the NDPS Act and that grant of anticipatory bail in such cases would shock the conscience of society, this Court is of the firm view that the petitioner does not deserve anticipatory bail. Accordingly, this Criminal Original Petition is dismissed. 09-06-2026 DRL
