Respondent PRAYER: Writ Petition filed under Article 226 of the Constitution of India seeking a writ of certiorari to call for the records of the respondent in connection with the impugned order passed in Rc.No.8155/D1/2007, R.O.577/2007, dated 20.10.2007 and C.No.D1/8155/2008, dated 02.07.2008 and C.No.D1/8155/07, dated 23.02.2009 and quash the same. ORDER

When the matter is taken up, learned Additional Government Pleader appearing for the respondent submitted that the original suspension order which is under challenge in this writ petition has been released now. He further stated that since the petitioner is attaining the age of superannuation today, he should not be allowed to retire from service due to the pendency of a criminal case against him Recording the above said submission, it is made clear that since the further criminal case is pending against the petitioner, he should not be allowed to retire from service. With this observation, the writ petition stands closed. No Costs.
