The petitioner, who was arrested and remanded to judicial custody on 22.06.2022 for the offences punishable under Sections 366(A) of IPC r/w 5(1) & 6 of POCSO Act 2012 in Crime No.244 of 2022 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that de-facto complainant's daughter was found missing from 09.06.2022. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the de-facto complainant's daughter and the petitioner herein were in love affair. On knowing about the same, the de-facto complainant had made arrangements for the marriage of the victim girl girl without her consent. Therefore, the victim girl and the petitioner had eloped from their home on 09.06.2022.

4. The victim girl is aged about 17 years. She was kidnapped and the petitioner had committed penetrative sexual assault on the victim girl. Therefore, the petitioner have committed very serious and heinous offence as against the minor victim girl and this Court is not inclined to grant bail to the petitioner.
