ORDER

This writ petition has been filed against the impugned summons dated 07.05.2026 issued by the 2nd respondent.

2. Mr.B.Pachaiyappan, learned Government's counsel, takes notice on behalf of the respondents.

3. By consent of the parties, the main petition is taken up for disposal in the stage of admission itself.

4. The learned counsel for the petitioner would submit that in this case, pursuant to the order dated 29.01.2026 passed in WP.No.2403 of 2026, summons were issued by 2nd respondent-Revenue Divisional Officer (RDO) to the petitioner for conducting enquiry. However, the said summon is supposed to have been issued by District Revenue Officer. Hence, this petition.

5. In reply, the learned Government's counsel appearing for the respondents would submit that the RDO-2nd respondent is only having power to cancel the patta and hence, the notice/summon was issued accordingly. Hence, he prays for dismissal of this petition.

6. Heard the learned counsel for the petitioner and the respondents and also perused the entire materials available on record.

7. In the case on hand, pursuant to the order dated 29.01.2026 passed in WP.No.2403 of 2026, summons were issued by 2nd respondent-RDO to the petitioner for conducting enquiry. However, according to the petitioner, the said summon is supposed to have been issued by DRO.

8. On the other hand, as rightly contended by the respondents, the 2nd respondent-RDO is only having power to cancel the patta and hence, the notice/summon was issued accordingly. In such case, it is clear that there is no error or illegality in issuance of the impugned summons.

9. In view of the above, this Court does not find any merits in this petition and hence, the same is liable to be dismissed. Accordingly, this writ petition is dismissed. No cost. Consequently, the connected miscellaneous petition is also closed.
