read with Order VII Rule 1 of CPC for the following reliefs: a) declaring that the election dated 22.11.2020 and the results announced on 24.11.2020 to the first defendant council insofar as the defendants 3 to 5 for the year 2020-2022, as null and void. b) permanent injunction restraining the defendants 3 to 5 from acting as office bearers to the post of Honarary Secretary, Treasurer and Vice President, pursuant to the election dated 22.11.2020 for the first defendant council.

c) to pay the costs of the suit;

JUDGMENT

The learned counsel for the plaintiffs submitted that the matter has become infructuous and sought permission of this court to withdraw the suit. He also made an endorsement in the case bundle to that effect.

2. In view of the submission of the learned counsel for the plaintiffs and the endorsement made in the case bundle, this suit is dismissed as infructuous. Registry is directed to return the Court fee as per Rules. No costs.
