Writ Petition filed under Article 226 of the Constitution of India praying to issue a writ or order or direction in the nature of writ of Mandamus directing the respondent to transfer the petitioner from Salem to any one of the place nearby to his native i.e. Sivakasi in the light of the guidelines stipulated in Letter (Ms) No.92/S/09 dated 22.07.2009 within a stipulated period as fixed by this Hon'ble Court and pass such other order or further orders as this Hon'ble Court may deem fit and proper.

O R D E R

The petitioner filed this Writ Petition seeking direction to the respondent to transfer the petitioner from Salem to any one of the place nearby to his native i.e. Sivakasi in the light of the guidelines stipulated in Letter (Ms) No.92/S/09 dated 22.07.2009 within a stipulated period

2. The learned counsel for the petitioner would submit that the petitioner is challenging the transfer from Kadayanalluyur https://hcservices.ecourts.gov.in/hcservices/

to Salem in which place he was not able to work due to lot of difficulties. Therefore he made a representation dated 27.02.2019 to transfer him to any one of the place nearby to his native i.e. Sivakasi in the light of the guidelines stipulated in Letter (Ms) No.92/S/09 dated 22.07.2009 but till date his representation was not considered by the respondent. Hence the present Writ Petition.

3. The learned counsel for the petitioner would submit that it would be suffice to issue direction to the respondent to pass orders on the representation dated 27.02.2019 submitted by the petitioner on merits and in accordance with law within a reasonable time.

4. Mrs. R. Janaki, learned Additional Government Advocate appearing for the respondent conceded to the limited request made by the learned counsel for the petitioner.

5. Without expressing any opinion on the merits of the case and considering the limited request made by the learned counsel for the petitioner, I am inclined to issue direction to the respondent to pass orders on the representation dated 27.02.2019 submitted by the petitioner on merits and in accordance with law within a period of twelve (12) weeks from the date of receipt of a copy of this order. With the above direction, the Writ Petition is disposed of. No costs.
