O R D E R

This Court by order dated 17.04.2025 has passed the following order in CMP.No.8138 of 2025 in CRP.No.1374 of 2025: "Notice to the respondent returnable by 17.06.2025. Private notice is also permitted.

2.Post the matter on 17.06.2025. There shall be an order of interim injunction till then."

2. Contenting that there is a non-compliance of the above order, this contempt petition is filed. This Court by order dated 30.07.2025 had appointed an Advocate Commissioner to note down as to whether a gate has been fixed in the 'B' Schedule property, for which an orders of injunction had been granted by this Court.

3. The learned Advocate Commissioner has visited the property and has filed his report dated 06.08.2025. In paragraph No.9 of the said report, the learned Advocate Commissioner has stated as follows: 2/4

"9.It is submitted that there is no gate in North-South pathway forming the 'B'Schedule. A gate exists at the entrance of the pathway running East West in S.No.74 that presently provides access to the 'B' schedule as shown in the Sketch prepared by the Surveyor. During inspection the said gate was open."

4. Considering the above, no contempt made out. Accordingly, this contempt petition is dismissed.
