ORDER : The Court Made the following order :- The petitioner, who apprehends arrest for the alleged offence under Sections 454 & 380 of IPC in Cr.No.103 of 2021, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner broke down the door of the house of defacto complainant and stolen 5 1⁄4 Sovereigns of gold and 250 grams of silver. Hence, the defacto complainant lodged a complaint before the law enforcing agency. Based on which, the law enforcing agency registered a case against the petitioner.

3.The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and the law enforcing agency with vengeance dragged the petitioner into this case. Hence, he prays for grant of anticipatory bail.

4.The learned Government Advocate (Crl.Side) submitted that apart from this case, there are several cases pending against the petitioner and which are similar in nature. Hence, he opposed to grant anticipatory bail to the petitioner.

5. Considering the previous cases pending against the petitioner and the property has not been recovered, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, the petition seeking anticipatory bail is dismissed.
