B.Manikandan .. Defendant Prayer: This Civil Suit has been filed under Order IV Rule 1 of O.S.Rules read with Order VII Rule 1 of C.P.C praying for judgment and decree as follows:-

1) Directing the defendant to execute Sale Deed or Sale Deeds for the suit property as per the suit sale agreement dated 01.08.2012 and register the same in favour of the plaintiff or his nominees on receipt of the balance of sale consideration Rs.5,00,000/- or

2) in the alternative directing the defendant to pay the plaintiff a sum of Rs.53,95,000/- with future interest at the rate of Rs.18% per annum till the realization of Decree amount.

3) granting such further or other reliefs

4) directing the defendant to pay cost of the suit to the plaintiff.

JUDGMENT

Suit for specific performance.

2. The defendant already set ex-parte.

3. In support of the plaintiff case, PW-1 has been examined and Exhibits P1 to P3 marked. The evidence of PW-1 and documents marked in support of the plaintiff's case, viz., P1 to P3 remain unchallenged.

4. It is found that the plaintiff has established that he is entitled for the reliefs sought for in the plaint.

5. The suit is decreed as prayed for. No costs.

6. The plaintiff is granted the relief specific performance in respect of sale agreement dated 01.08.2012, as prayed for.

7. Time for paying balance sale consideration of Rs.5,00,000/- and the sum of Rs.27,50,000/- is one month. Thereafter the defendant is granted two months time for executing the sale deed.
