ORDER
(Order of the Court was made by the Hon'ble Anita Sumanth J) The Writ Appeal filed by the State has been dismissed on 12.09.2022 and the matter was directed to be listed for reporting compliance on 10.10.2022. The matter has come up thereafter on 11.10.2022, 17.10.2022, 23.11.2022 and 25.11.2022.
2. On 25.11.2022, the appellant had filed an affidavit dated 24.11.2022 to the effect that proposals for regularization have been forwarded to the Commissioner of Rural Development and Panchayat Raj Department and thereafter to the Government. Upon completion of procedural formalities for which they sought 3 months time, full compliance will be effected.
3. A year later, the respondent/Writ Petitioner filed a reply dated 03.10.2023 pointing out that there has not been any compliance with the directions and also that the undertaking under affidavit dated 24.11.2022 has not been given effect to. They hence, sought a slew of directions for disbursal of all remaining service and monetary benefits set out under clauses (i) to (viii) of paragraph 14 of affidavit dated 03.10.2023. A second status report was filed by the respondent/Writ Petitioner on 03.06.2024.
4. Today when the matter is called, the second respondent files yet another status report dated 05.12.2024 to the effect that pension has been sanctioned on the basis of the petitioner's acquiescence of option for commutation of pension on 14.10.2022.
5. We find that the hearings in regard to the compliance have spread over for the last 2 years and it is presently the stand of the appellants that they have complied with in full. However, the respondent/Writ Petitioner is still unhappy and states that compliance is yet not complete.
6. We record the rival contentions and close the matter at this juncture. Liberty is always available to the Writ Petitioner to file a contempt petition if the petitioner is of the view that
there are yet more directions in order of the Division Bench dated 12.09.2022 that remain uncomplied in that regard. Limitation to run from today. (ANITA SUMANTH J.) (G.ARUL MURUGAN J.) 06-12-2024 To
