(In all WPs) COMMON ORDER 1.These writ petitions have been filed by the Secondary Grade Teachers, who are working in the Elementary, Middle School and Anganvadi centers, since they have been transferred as surplus teachers within the union/outside union and some of the petitioners have been deployed in Anganvandi centers, though they were secured P.G. Qualifications.
2.The State Government has issued G.O.(1D) No.217, dated 20.06.2019, framing guidelines for conducing redeployment of surplus teachers in Education Department and as per which, the seniority of the teacher redeployed to different unit will be maintained in the parent unit and the redeployed teacher in different unit will be restored to his/her parent unit as and when vacancy arises in the subsequent academic years. While so, in order to accommodate the surplus teachers available in the same union/outside union of the petitioners based on the availability, the petitioners were transferred to some other unions.
In nutshell, the petitioners were earlier transferred outside their parent units subject to the condition that they would be transferred back to their parent unit/union/ as and when vacancies arise in subsequent years and in such process, only after considering the deployed teachers outside unit, the remaining vacancies will be subjected for general transfer counseling and as such, the petitioners are entitled to get transferred back to their respective parent units, whereas, the impugned transfers have been passed ignoring the right of the petitioners and they were deployed to other units being surplus teachers. Challenging their transfer orders, the petitioners have come forward with the present Writ Petitions.
3.The learned counsel appearing for the petitioners would submit that admittedly the seniority of the teachers working in the Elementary and Middle Schools are union seniority. If they are transferred on their own from parent union to another union, they have to necessarily to forgo the seniority. However, the petitioners' seniority is protected in the G.O.(ID) 217 School Education (Pa.Ka.5(1) Department dated 20.06.2019 if they were transferred by way of deployment. He would point out that there was much inconvenience caused by way of deployment the learned counsel would further submit that even if transfer of a person from one union to another union, if any future vacancies arises in the same union, the priority has to accommodate to the teachers who were transferred from one union to another union and without re transferring the teachers who were already transferred to some other union, they are filling the said vacancies in the same union with other surplus teachers who were juniors to the petitioners.
4.Mr.G.Shankaran, learned counsel appearing for the petitioners would submit that even in the same unions there were needy posts available and if such post is identified and the same can be filled by accommodating the petitioners by way of deployment to other unions and the said vacancies can be filled based on the regular seniority in respect of the unions based on the original seniority. The learned counsel for the petitioners would submit that the respondent can easily solve this issue by implementing the norms prescribed in the G.O. (1D) No.217, dated 20.06.2019 particularly mentioned in paragraph 4 (1) (i), (ii), (iii) & (iv).
If said procedure is implemented in letter and spirit, it would suffice and this Court may issue suitable direction to the respondents accordingly and the said exercise shall be completed within reasonable time from the date of receipt of copy of this Order. 5.The learned counsel appearing for the petitioners, in order to solve the issue this Court may issue a direction to the respondents to comply with the norms fixed in the G.O.Ms.No.217, paragraph 4(1)(ii) within a reasonable time fixed by this Court.
6.Mr.C.Munusamy, learned Special Government Pleader appearing for the respondents would submit that as per paragraph 4(i) to (iv) G.O.Ms.No.217, on earlier occasion, the surplus teacher are identified based on the student -teacher ratio and as per Clause (i) of the said G.O., the surplus teachers were transferred to the needy school in the same union or outside union. However, the need post has to be identified by the Education Department as per sanction and thereafter only the said posts can be filled by re- transferring the surplus teachers who were already transferred from one union to another
union. However, on instruction, the learned Special Government Pleader would submit that the norms in G.O.Ms.217 particularly, in paragraph No.4 will be implemented, if this Court issues direction to the respondents, and the said exercise shall be completed within reasonable time granted by this Court. 7.According to the petitioners, they have been deployed as being surplus teachers from their respective unions to other unions and while resorting to the deployment, the respondents have not following the original seniority, but they followed only station seniority, which procedure is contrary to the present G.O.(1D) No.217 dated 20.06.2019. Therefore, the petitioners now made a limited request to direct the respondents to implement the G.O.Ms.217 particularly, the norms mentioned in paragraph No.4 within reasonable time. Considering the limited request made by the petitioners, I am inclined to issue a direction to the respondents are as follows:
● The respective Education Authorities i.e. The Directorates of Elementary and School Education are directed to implement the G.O.Ms. No.217 particularly, the norms mentioned in paragraph No. 2 (i) & (ii), 3 (i) & ii) and 4 (i) to (iv);
● The Directorates of Elementary and School Education are directed to identify the need posts in the respective unions and in respect of the sanctioned posts by the Government and thereafter the said need posts have to be filled with by the teachers who were transferred from parent union to another union and give priority based on their original seniority.
The said exercise should be completed within a period of six weeks from the date of receipt of copy of this order. 8.With the above direction, these writ petitions are disposed of accordingly. No costs. Consequently, connected miscellaneous petitions are closed.
