O R D E R

The petitioner, who was arrested and remanded to judicial custody on 11.02.2025 seeks bail in S.C.No.94 of 2017 for the offence punishable under Sections 364, 394 read with Section 397, 302 of IPC in connection with Crime No.472 of 2015, registered on the file of the respondent. 1/4

2. The learned counsel appearing for the petitioner submitted that the petitioner was arrested on the strength of the NBW and he is in prison from 11.02.2025. He further submitted that the petitioner is a sole breadwinner of his family and due to his prolonged incarceration, his family is suffering. He further submitted that the petitioner undertakes to co-operate with the trial.

3. The learned Government Advocate (Crl. Side) strongly opposed for grant of bail to the petitioner stating that the case is pending from the year 2015 and due to the absence of the petitioner, the trial could not be completed and it is a single accused case and the petitioner is absconding and due to which, NBW was issued on 09.12.2024 and executed only on 11.02.2025. He further submitted that if the petitioner released on bail, there is a possibility that the trial could be stalled.

4. Considering the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner at this stage.

5. Accordingly, this Criminal Original Petition is dismissed. The trial Court 2/4
