JUDGMENT

The learned counsel for the respondent has filed a memo on 18.06.2018 stating that the sole appellant died on 09.05.2013 itself and also, he further stated that since already limitation period has expired for bringing the Legal representatives, the appeal has to be dismissed as abated. However, with a view to give an opportunity to the legal representatives of the appellant to enable them to file a petition to implead themselves as legal representatives, two adjournments were given. But today also, the learned counsel for the appellant has made a request to grant some more time. Considering the fact that already sufficient time has been given, his request is rejected. This second appeal is dismissed as abated.
