vs S.Krishnamoorthy ....Respondent Writ petition is filed under Article 226 of the Constitution of India praying for issuance of a Writ of Certiorarified Mandamus, to call for the records on the file of the Additional Labour Court, Coimbatore in I.D.No.75 of 2019, to quash the preliminary award dated 15.04.2021 and consequently direct the Labour Court to reject the dispute raised by the respondent.

ORDER

Writ petition is filed challenging the Award of the Labour Court dated 15.04.2021.

2. It is submitted by both the learned counsels that during the pendency of the present writ petition the main I.D.No.75 of 2019 on the file of the Additional Labour Court, Coimbatore was taken up for disposal and the Award was passed on 21.11.2023 awarding compensation of Rs.5 Lakhs in lieu of the reinstatement without backwages.

3. The learned counsel for the respondent submits that nothing further survives in this writ petition.

4. The learned counsel for the petitioner on the other hand submits that the present writ petition may be closed with liberty to both the parties to raise all the issues including the issues involved in this writ petition, in case challenge is made in I.D.No.75 of 2019.

5. I have considered the submissions of both the learned counsels.

6. The writ petition is accordingly disposed of with liberty to both the parties to challenge the Award in the manner known to law in case of challenge and both the parties would be at liberty to raise all the issues including the issue of status of the respondent, whether he is a workman or not.

In view of the above writ petition is disposed of. No costs. Consequently connected WMP is closed.
