..Respondent(s) PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying for a writ of Certiorarified Mandamus calling for the entire records relating to the impugned order passed by the 2nd respondent in his proceedings NO.Pe.Na.Se.Maa.Ma.Na.A.IX/ Na.Ka.No.0148 of 2026 dated 18.2.2026 and quash the same as illegal arbitrary and contrary to section 15 of the Registration of Births and Deaths Act 1969 and consequently directing the 1st and 2nd respondents to cancel the birth certificate which was registered on 3.3.2005 vide Reg.No.2005/06/088/50 and to rectify the date of birth of the petitioners son from 2.3.2005 to 2.11.2004 within a stipulated period of time fixed by this Court.

ORDER

By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

2. The present writ petition is filed challenging the order of the 2nd respondent dated 18.02.2026 and quash the same as illegal, arbitrary and contrary to Section 15 of the Registration of Births and Deaths Act, 1969, and consequently direct the 1st and 2nd respondents to cancel the birth certificate which was registered on 3.3.2005 vide Reg.No.2005/06/088/50 and to rectify the date of birth of petitioner's son from 02.03.2005 to 02.11.2004.

3. After submitting for a brief while, when it was pointed out by the learned counsel for respondent that there is an alternate remedy by way of appeal in terms of Rule 17 of the Registration of Births and Deaths Act, 1969, 2023, learned counsel for petitioner would only seek leave of this Court to file an appeal within a period of 10 days.

4. In view thereof, the writ petition is disposed of with liberty to the petitioner to file an appeal before the appropriate authority within a period of 10 days from the date of uploading of web copy without waiting for receipt of certified copy of the order. If any such appeal is filed by the petitioner, the same

shall be admitted and disposed of by the concerned respondent within a period of four weeks from the date of filing of such appeal, without reference to limitation, if it is otherwise in order. No costs. Consequently, the connected miscellaneous petitions are closed.
