ORDER
The petitioner, who was arrested and remanded to judicial custody on 20.05.2025, for the offences punishable under Sections 147, 148, 336, 427, 307, 506(ii) r/w 34 of I.P.C. in connection with Crime No.844 of 2006, on the file of the respondent police, seeks bail. 2.The case of the prosecution is that the petitioner along with other accused assaulted and attacked the de-facto complainant. Hence, the case. 3.The contention of the learned counsel for petitioner is that the petitioner was arrested on 20.05.2025 in PRC No.9 of 2018. In this case there are two accused, the petitioner is ranked as A1. As regards A2, NBW is pending against him. Hence, there is no progress in the case and the petitioner has been kept in prison endlessly without any progress. Hence, he prays to grant bail to the petitioner.
4.The learned Government Advocate (Crl. Side) appearing for the respondent submitted that there are totally 29 accused in Crime No.844 of Page No.2 of 4
2006. On conclusion of investigation, PRC No.110 of 2010 filed and the same was pending before the Committal Court. Thereafter, the case was committed before the learned XXIII Additional Judge, Chennai in S.C.No.133 of 2018 and learned Additional Judge, by a judgment dated 01.08.2022, acquitted 16 of the accused, who faced trial. The petitioner was absconding even before committal. Hence, NBW issued on 05.12.2016 against the petitioner and 4 others and the case was split up in PRC No.9 of 2018. In this case, of the 5 accused, three accused no more. Against petitioner/A1 NBW executed on 20.05.2025. As regards A2, NBW is pending. He further submitted that the offence took place 21 years ago and still the case is yet to be committed. Hence, strongly opposed for granting bail to the petitioner.
5.In view of the same, this Court is not inclined to entertain this bail petition and the same is dismissed.
