This writ petition has been filed seeking issuance of a writ of mandamus directing the second respondent to forward the clearance certificate to the first respondent and consequently, direct the first respondent to issue passport to the petitioner based on the application submitted by the petitioner on 25.08.2023.

2. Heard Mr.I.Arockia Selvaraj, learned counsel for petitioner, Mr.Srivatsan Sridhar, learned Central Government Standing Counsel appearing for first respondent and Mr.Leonard Arul Joseph Selvam, learned Government Advocate [Crl.side] appearing for second respondent.

3. Learned Government Advocate appearing on behalf of the second respondent submitted that a First Information Report is pending before the second respondent in Crime No.502 of 2015 against the 2/4

petitioner for offence under Section 304(ii) IPC. Learned Government Advocate submitted that investigation is yet to be completed.

4. Taking into consideration the facts and circumstances of the case and the materials placed before this Court, it is seen that the First Information Report registered against the petitioner is yet to get itself translated as a police report and therefore, as on date, there is 'No Case Pending' against the petitioner. Hence, there shall be a direction to the second respondent to issue necessary clearance certificate to the first respondent and the first respondent shall thereafter process the application and issue the passport, if the petitioner satisfies all the other requirements, within a period of four (4) weeks from the date of receipt of a copy of this order.

This writ petition is disposed of with the above direction. No costs.
