A. Nos. 2318, 2193 of 2026 & 5870 of 2024 in C.S. No. 228 of 2024 DR. A.D. MARIA CLETE, J Learned Senior Counsel appearing for D1, D2 & D4 and the learned counsel for the plaintiffs submits that the matter has been settled between the parties and an application in A. No. 2318 of 2026 has been filed to implead the Developer of the suit schedule property and only if this application is allowed, there can be a holistic settlement of the disputes between the parties and the learned counsel for the plaintiffs also submits that she has got no objection in allowing this application and has made an endorsement to that effect. However, it is seen that the service is pending as regards D3. Hence, learned counsel for the plaintiffs is directed to effect service to D3.

2.Accordingly, Issue notice to D3 returnable by 15.07.2026 both in the suit and in the applications. Private notice is also permitted. The applicant(s) is permitted to serve notice on D3 by speed post / RPAD and shall file an affidavit of service with proof of dispatch and delivery on or before the next hearing date. 3.Registry is directed to list the matter, after the completion of service of court notice along with service notes and proof of service on 15.07.2026.
